न्याय के पक्ष में भारत सरकार का दोहरा मानदंड-आनंद जान बनाम अन्य

आज दोपहर दैनिक भास्कर की खबर पढ़कर मैं थोडा चौंका.खबर थी-'दुबई में हत्या के आरोप में मौत की सज़ा पाने वाले पंजाब और हरियाणा के विभिन्न जिलों के १७ युवकों के मामलों को लेकर ६ अप्रैल को विदेश मामलों की सचिव दिल्ली जा रही हैं.विदेश राज्यमंत्री परनीत कौर ने ये बातें कहीं.इन युवकों के परिजनों से मिलने के बाद इस मामले को संजीदा मानते हुए विदेश राज्य मंत्री शशि थरूर ,विदेश मंत्री एस.एम.कृष्णा संयुक्त अरब अमीरात(UAE) सरकार के लगातार संपर्क में हैं,साथ ही इन युवकों को बचाने के लिए लोक भलाई पार्टी के राष्ट्रीय प्रधान बलवंत सिंह रामूवालिया तीन सदस्यीय कमिटी के साथ ८ अप्रैल को दुबई जा रहे हैं.
भारत सरकार का यह कदम काबिले तारीफ़ हैं और उनके इस कदम से हमारा विश्वास और भी पुख्ता हुआ है कि अन्य देशों की ही तरह हमारी सरकार भी हमारे विदेश में काम के लिए गए नागरिकों के लिए,उनके हकों के लिए कितनी गंभीर है.पर तस्वीर का एक दूसरा पहलू भी है.पिछले वर्ष एक माँ और बहन विभिन्न रसूख वाले लोगों तथा हमारे ऊपर लिखित राजनयिकों तक से यहाँ तक की विभिन्न संस्थाओं के दरवाज़े पर लगातार दौड़ रहीं हैं और केवल आश्वासन के सिवा तब भी कुछ नहीं मिला और आज तो खैर उसकी यह उम्मीद भी धूमिल हो रही है क्योंकि उस बेटे और भाई को लास-एंजिल्स कोर्ट ने पहले ही ५९ साल की कैद सुना रखी है और फिलहाल वह अपने एक और मामले की सुनवाई में इसी ७ अप्रैल को न्यूयार्क कोर्ट में पेश होने जा रहा है.इस बारे में कहीं भी कुछ ना तो लिखा जा रहा है ना सरकारी तौर पर भी कोई कदम (मात्र एक नज़र केस को देखने भर की जेहमत भी नहीं )ही उठाया जा रहा है.यह शख्स है अमेरिका स्थित मशहूर फैशन डिजाईनर आनंद जान.क्या आनंद के केस में कुछ भी कदम उठाने से भारत सरकार और अमेरिकी गवर्नमेंट के संबंधों में कुछ दिक्कत आ जाएगी?या आनंद के मामलें से सरकार को ना तो वोटों का कुछ फायदा होने वाला है(क्योंकि आनंद अमेरिका बेस्ड भारतीय नागरिक है)क्योंकि जो लोग इस तरह के कारोबार से जुड़े हुए हैं उनकी भारतीय प्रजातंत्र में कोई ख़ास रूचि नहीं है?या फिर इसके पीछे हमारी वह मानसिकता काम कर रही है जहां 'अंकल सैम'को खुश करने के लिए हमारे चुने चेहरे कुछ भी कर सकते हैं ?मेरे यह कहने के कुछ जायज़ कारण हैं.आखिर वह पीछे की सच्चाई क्या है जहाँ आनंद जान आज एक यौन उत्पीडन या रेपिस्ट की तरह देखा जाने लगा है.आनंद पर यौन उत्पीड़न के कई मामलें अमेरिका के विभिन्न कोर्ट्स में चल रहे हैं और एक मामले में उसे उन्सठ सालों की कैद हुई है.एक केस का खता अभी सात अप्रैल को न्यूयार्क में खोला जाना है पर कहीं कोई चर्चा नहीं कोई सपोर्ट नहीं,ना सरकारी तौर पर ना ही गैर-सरकारी तौर पर.आईये अब देखते हैं आनंद जान का मामला और आनंद जान आखिर है कौन और इस मामले में लूप-होल कहाँ है-
Anand jon alexander is one of the most high-profile south-asians credited for introducing "indo-chic"as the first indian to show at NY fashion week,Bryant park.he was featured by newsweek magazine's "who's the next 2007",selected as faces of the future by india today;winner of numerous awards and accolades ,including the rising star award'for the Asia Society and for Fashion Week of the America's.while he was a celebrity judge for miss india and regularly featured on TV shows such as America's next top model it is no coincidence that almost all these allegations stemmed around the timeframe of his Wall Street financing.
Anand jon was raised in south india by an affectionate and well respected family and graduated from Bharthiya vidya bhavan,Kerala.and later at padma seshadri,Saint Michael's academy in chennai.At age 16 he went on a scholarship to the Arts Institute of Fort Lauderdale where he graduated as the valedictorian.Anand jon transferred to the prestigious Parsons School of Design,the New School where he graduated with a double degree in 1998,Tim Gunn was the Dean of the New School during Anand jon's matriculation;he is the current host of Project Runway and Tim Gunn's guide to style.Mr.Gunn described Anand jon in his recommendation release as"a visionary and a leader".
At 24 Anand Jon teamed up with his mother and sister and became the first indian to show at NewYork Fashion Week/Bryant Park and went on to have the who's who of society.celebrity and young royalty as his clients.Those clients and friends include:Paris hilton,Amanda and Lydia Hearst,Bruce Springsteen,LawrenceFishburne,Gina Torres,Oprah Winfrey,and Janet Jacson to name a few.As a result of his success,Anand jon sold collections at highly respected establishments including Bergdorf Goodman,in New York City,Wilkes Bashford,in San Francisco,and Luisa Via Roma,in Florence,Italy.Anand jon's active role in charities includes the AIDS Awareness Tour to India with Miss Universe and his sister Sanjana jon and included Michelle Rodriguez and Kal Penn in the launch at the United Nations in New York.He supported the Tsunami Relief with Hillary clinton in 2005 and the Nature Sanctuary for abused animals.
Unfortunately,the price of success and fame resulted in placing Anand jon and his family as targets for what appears to be nothing short of a conspiracy involving his own disgruntled business associates and roommates.Their failed extortion attempts and publicity attempts and civil suits turned into criminal allegations,At least six of these witnesses are involved in suing Anand jon civilly.

अब एक नज़र आनंद जान के केस के ऊपर जिनमें कई तथ्यात्मक और गंभीर अनदेखियाँ हैं जिनकी ओर आनंद की बहन संजना जान और उसकी माँ शशि अब्राहम लगातार भारत सरकार को देखने को तथा इस मामले को अपनी देख-रेख में करवाने के लिए दरवाज़े-दरवाज़े घूम रही हैं.उनका मानना है कि इस मामले की सुनवाई सुनवाई निष्पक्ष रूप से नहीं हुई है और एक बहुत बड़ा नेटवर्क इसके पीछे काम कर रहा है.नस्लीय भेद भी इसका एक पेंच है.भारत सरकार से इनकी मांग रही है कि -we are asking that the indian government watch to make sure that these proceeding are conducted properly.A glance at this case raises serious concern of racial prejudice,prosecutorial misconduct,and gross human and civil rights violations throughout the proceedings.this demand is based on the outrage of the international indian community regarding the injustice an Anand jon case,to highlight a great injustice being committed toa young indian citizen and request the government of india to intervene and take active participation on behalf of one of their citizens,Anans jon,by ensuring that justice is served.इसके कारण साफ़ हैं क्योंकि the court records show absence of a fair investigation,a fair prosecution,fair jury,or fair trial.At the very least Anand jon deserves a fair new trial with a fair bail immediately.and the only way now he can get a fair trial is by extraditing him back to india.(ध्यान दें कि यह बातें और मांगें आनंद के उस मामले से सम्बंधित हैं जिस केस में आनंद को उनसठ साल की सज़ा काट रहा है.)इस सज़ा पा गए केस के असली चेहरे को देखते हैं कि क्या हुआ कोर्ट के द्वारा और यौन उत्पीड़न के सबूत क्या क्या थे?
1-despite a negative rape kit and witness statements favourable to his innocence Anand jon was areested in march 2007,in Beverly hills.Anand jon has been held in solitary confinement for over two years without even a fair bail.
2-at least one of more jurors admits that they wanted to vote not guilty until they were pressured to change their vote against their will.
3-Anand jon passed a polygraph(lie detector test)based on these charges .the prosecution lied to the New york times to creat a negative media hysteria stating"violent crimes";
4-जबकि रेप किट निगेटिव था आनंद को सज़ा सुना दी गयी,prosecutions own lead expert Dr.Schulman admitted -"no signs of use of any force,no injuries,no trauma,"
ये सब तो वह कुछ बातें हैं जिनकी जबरदस्त उपेक्षा इस केस में की गयी और आनंद को ५९ वर्ष की जेल की सज़ा दे दी गयी.यह कहाँ तक जायज़ है कि जबकि जिस रेप केस में आनंद जान जेल जा रहा है उस केस में उसकी इस मांग को गौर करने लायक नहीं सोचा गया कि आरोप लगाने वाली महिला का भी एक बार पोलीग्राफ टेस्ट हो,यही नहीं जबकि चलते केस के दौरान जूरी के एक मेंबर ने संजना को(आनंद की एकलौती बहन) फोन पर अनुचित मांग के साथ यह कहा कि we know anand is innocent.तब अदालत ने आनंद के juror misconduct (among other infraction)के कारण न्यू ट्रायल की मांग को ठुकरा दिया उस पर ध्यान नहीं दिया गया.इतना ही नहीं नस्लीय भेदभाव की बात कहने के भी कई वजहें हैं मसलन,it is surprising to note the amount of racist comments that exist in various documents of court proceedings.one is also shocked at some of the comments by the prosecution's witnesses during the trial including,"indiaheads"and "curry smelling dick"while the prosecution themselves seemed to have inflamed racially prejudiced suggestions such as "attacking white woman".
अब इतने सारे लूप होल के बावजूद आनंद जेल में है यह हमारी सरकार का दोहरा रूप दिखा रही है.आनंद सपरिवार अकेले इस जंग में खड़ा है तमाम सरकारी दरवाजों पर चक्कर काटने के बात आनंद को अमेरिकी सत्ता से जेल ही मिल रही ही है,और आगे हमारी सरकार कुछ करेगी,अभी तो उम्मीद बेमानी है.पर एक बहन और माँ की हिम्मत को सलाम जिन्होंने विपरीत परिस्थितयों में भी भाई को हिम्मत दिया हुआ है और इस बात में यकीं रखती हैं कि सत्यमेव जयते.पर पंजाब हरियाणा के युवकों के लिए सरकार इतना कुछ कर सकती है पर वहीँ आनंद क मामले से इतनी बेरुखी क्यों ?यह दोहरा चरित्र क्यों?
